Legal Entity: Help For All Australia
Website & Services: https://hfaa.com.au/ and any related apps, tools, and features (collectively, the “Platform” or “Services”).
By creating an account, purchasing a subscription, or using the Platform, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Platform.
1) About the Platform
We provide an all-in-one, subscription-based platform that connects job seekers with employers across Australia. Employers can post roles, manage applicants, and communicate directly with candidates; job seekers can browse and apply to listings and message employers. We are not an employment agency, labour hire provider, or party to any employment relationship formed between users. We do not guarantee any hire, job placement, pay rate, or outcome.
2) Eligibility & Account Registration
2.1 Minimum age. You must be at least 18 years old to use the Platform.
2.2 Accurate information. You agree to provide true, current, and complete information during registration and to keep it up to date.
2.3 Authorization to hire. Employers represent they have authority to recruit and to make offers of employment or engagement in Australia.
2.4 Account security. You are responsible for safeguarding your login. Do not share your credentials or let others use your account.
3) Subscriptions, Fees, Trials & Renewals
3.1 Paid access. Access to core functionality requires an active subscription (plan details and pricing shown at checkout). Subscriptions are billed in advance and renew automatically at the then-current price until cancelled.
3.2 Free trials & promos. Where offered, trials convert to paid plans unless cancelled before the end of the trial. We may change or withdraw promotions at any time.
3.3 Taxes. Prices are exclusive of applicable taxes and charges, which may be added at checkout.
3.4 Refunds. Except where required by Australian Consumer Law (ACL), all fees are non-refundable. These Terms do not exclude non-excludable consumer guarantees under the ACL; see Section 15. (ACCC)
3.5 Chargebacks. Initiating unwarranted chargebacks may result in suspension. We may dispute chargebacks with your payment provider.
4) Acceptable Use & Prohibited Conduct
You agree not to:
a) Post unlawful, misleading, discriminatory, defamatory, obscene, or harmful content;
b) Misrepresent identity, qualifications, right-to-work, pay rates, or job conditions;
c) Engage in harassment, spam, or unsolicited commercial messages via Platform messaging;
d) Scrape, index, or bulk-download content, or interfere with Platform security or availability;
e) Post roles that are illegal, unsafe, or require upfront payment from job seekers.
5) Employer Responsibilities
5.1 Accurate listings. Employers must ensure job ads are truthful (role, duties, location, pay range, work type, and prerequisites) and comply with applicable workplace, anti-discrimination, and pay transparency obligations.
5.2 Hiring decisions. Employers are solely responsible for screening, interviewing, background checks, right-to-work verification, and final hiring decisions. We do not perform these checks.
5.3 No fees to applicants. Job seekers must not be charged application fees, training fees (unless lawful and disclosed), or other improper costs as a condition of being considered.
6) Job Seeker Responsibilities
6.1 Truthful profiles. Resumes, profiles, and applications must be accurate and free of misrepresentation.
6.2 Professional conduct. Communicate respectfully and keep information confidential if an employer designates it as such.
6.3 Independent diligence. Evaluate roles independently; we do not vet or endorse any employer.
7) Messaging & Communications
Platform messaging is provided for legitimate recruitment communications only. We may monitor, scan, or retain messages to maintain service integrity, prevent abuse, and comply with law (see Privacy Policy). Direct marketing must comply with Australian spam laws and include valid unsubscribe mechanisms where applicable. (acma.gov.au)
8) User Content & License
8.1 Your ownership. You retain ownership of content you submit (job posts, profiles, resumes, messages).
8.2 License to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute your content as necessary to operate, improve, and promote the Platform.
8.3 Moderation. We may edit, refuse, or remove content that breaches these Terms or the law.
9) Our IP & Limited Licence
The Platform, including software, features, design, and trademarks, is owned by us or our licensors. Subject to your compliance, we grant you a limited, revocable, non-transferable licence to use the Platform for its intended purpose.
10) Third-Party Services & Payment Providers
We may integrate third-party services (e.g., payment processing, analytics, communications). Your use of such services may be subject to their terms. We are not liable for third-party acts or omissions.
11) Availability, Changes & Beta Features
We strive for reliable access but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature, including beta features, at any time. Where feasible, we’ll provide notice.
12) No Agency, Employment, or Advice
We are not a party to any employment, contracting, or payment arrangement between users and do not provide legal, HR, migration, tax, or employment advice. You should obtain your own independent advice.
13) Privacy & Data Protection
Our handling of personal information is described in the Privacy Policy. We manage personal information in line with the Australian Privacy Principles (APPs) where applicable, and we follow the Notifiable Data Breaches (NDB) scheme for eligible breaches. (OAIC)
14) Direct Marketing & Spam
If we send electronic marketing, we will comply with the Spam Act 2003 (e.g., consent, sender identification, functional unsubscribe). Users must also comply when sending commercial electronic messages via the Platform. (acma.gov.au)
15) Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantees under the ACL. Where services are not supplied in accordance with the ACL, you may be entitled to remedies. To the extent permitted by law, our liability for breach of a consumer guarantee is limited to resupplying the services or paying the cost of resupply. (ACCC)
16) Disclaimers & Limitation of Liability
16.1 As-is services. Except for non-excludable guarantees, the Platform is provided “as is” and “as available.”
16.2 No special damages. To the maximum extent permitted by law, we are not liable for loss of profit, revenue, goodwill, data, or indirect/consequential loss.
16.3 Aggregate cap. Subject to Section 15 and applicable law, our total liability arising out of or in connection with the Services in any 12-month period is limited to the greater of (i) AUD $100 and (ii) amounts you paid to us for the Services in that period.
17) Indemnity
You indemnify us (and our officers, employees, and agents) from claims, losses, and costs arising from: (a) your breach of these Terms; (b) your content; (c) your misuse of the Platform; or (d) disputes between you and any other user.
18) Suspension & Termination
We may suspend or terminate your access (with or without notice) if we reasonably believe you breached these Terms, pose a risk, or to comply with law. You may cancel anytime; cancellation takes effect at the end of your current billing period.
19) Disputes & Complaints
Contact us first at [support email]. We’ll aim to resolve complaints promptly and fairly. Nothing prevents you from seeking assistance from a regulator or court of competent jurisdiction.
20) Governing Law & Jurisdiction
These Terms are governed by the laws of Australia and the State of New South Wales. Courts of New South Wales have exclusive jurisdiction.
21) Changes to These Terms
We may update these Terms. We’ll post changes on the Platform and update the “Effective Date.” Your continued use after changes constitutes acceptance.
